Why independent representation matters in Dubai's off-plan market

The off-plan market in Dubai has grown rapidly over the past decade, and with it the number of private clients acquiring high-value residential property directly from developers, often without independent representation at any stage of the process.

This matters because developers and their agents operate with commercial incentives that are, by definition, not aligned with your interests as a buyer. The price is set by the developer. The payment schedule is structured to suit the developer's cash flow. The unit allocated to you may not be the one you toured. And the completion timeline, once committed, becomes legally binding for you but subject to extension for them.

None of this means off-plan acquisition is inherently risky, but it does mean that the risk is structural, and that without independent eyes at the pre-commitment stage, you are absorbing it unknowingly.

Independent representation at this stage typically covers three things: a rigorous review of the developer's delivery track record and financial standing; an assessment of the unit, specification and contract terms against comparable transactions; and early design input where the acquisition involves fit-out or customisation. Together, these create a basis for commitment that is grounded in evidence rather than marketing.

For clients who do not normally operate in this market, the investment in independent advice at the outset is materially lower than the cost of discovering its absence later.
